When is Topless Really Topless?

Tennessee middle school teacher Melinda England is in the middle of a controversy over "questionable" photos posted on the Internet showing her topless with her hands over her breasts.

Teachers maintain their First Amendment rights but England could be disciplined according to Tennessee state law that has a provision addressing unprofessional behavior by teachers.

Undoubtedly there would be no problem if she was a man showing nipples, or if one of her students saw her on a beach wearing a skimpy bikini.
