Not Indecent

A federal appeals court has sided with the Fox Television Network which argued that FCC sanctions against "fleeting expletives is arbitrary and capricious".

The ruling bodes well for the CBS appeal of the severe fines levied against the network over the brief exposure on televison of Janet Jackson's breast at the Super Bowl in 2004. Should the CBS appeal succeed it could mean that government might have no Constitutional ability to censor the airwaves at all.
